In MN the 'hunting' aspect wouldn't need to enter in. It would come
under harassing wildlife, which is may or may not be a big no-no,
depending on where and how you do it, who reports you, and who writes
(or chooses to warn instead) the ticket.

OTOH, I've never heard of anyone getting even a warning for protecting
their property by means of water, mild electrical, visual, or scent
effects. I'm not sure about high power water cannons, but hoses and
sprinklers are okay.

Don't really know the particulars here in Wisconsin, but I suspect we also
have some shades of gray. Milwaukee county has a justly famous park system,
built to a large extent around green belts along several rivers and streams.
One unintended (I assume) result is that deer are likely to show up
virtually anywhere. And there are a LOT of them. I don't know if anything
ever came of it, but a few years ago there was talk of hiring professional
sharpshooters to thin the herd. Regardless of the letter of the law, I
suspect that a cop's or warden's reaction to someone popping a deer in the
ass with a BB gun when caught molesting the roses would be highly variable,
depending on the neighborhood, recent unpleasantness, individual mood, etc.
For example, an Elm Grove resident (read, VERY white, well connected, and
almost certainly a contributor to any number of benevolent organizations)
upholding the virtue of the hostas would likely receive something less than
a stern informal request to knock it off. On the other hand, a sixteen year
old black male near what used to be Northridge Mall (or Capitol Court, or
Mayfair, or Southridge, or Bayshore......or anywhere in Elm Grove or
Wauwatosa or southeastern Wisconsin, or.....well, you get the picture) would
probably go to jail......um.....well, pieces of him, anyway. Oddly, busting
bunnies with a blowgun (I've heard that sort of thing actually
happens......right here in Milwaukee!) and for precisely the same offense,
is likely to provoke a stronger reaction regardless of mitigating
circumstances. Go figure.

Anyway, even the scarily (if not quite omni) potent DNR is not likely to get
too worked up (the cops are another matter entirely) about it unless they
view it as a game violation.....that is to say, poaching. And even they (I
think) are not quite fascistic enough to believe that BB gun + deer +
petunias + urban setting necessarily = poaching. But, if they DO, then God
help you cuz they WILL go medieval on your sorry ass.

um.....live trapping bunnies is o.k.......i think.....poisoning....well,
nobody really cares.....crushing their heads with a paving
brick?....mmmmm.....do it quietly....but do NOT go the blowgun route!
