Default The Stick Worm Phenomenon

We really can't call them Senkos anymore. Its a Yamamoto trade name. While
Gary Yamamoto started something with these and deserves all the credit for
this new bait, many other manufacturers have their own version that produce
nice sizes and quantities of fish. It is a disservice to Yamamoto and Yum,
Swee****er, Mesa Tackle, and others to call them all Senkos.

Regardless of the manufacturer those baits have a generic name. If I said I
was fishing with a watermelon red flake "knock off" nobody would know what
it was.

As a manufacturer, I can assure you that Gary Yamamoto absolutely loves
having people refer to all Senko-type baits as Senko's! When a
manufacturer's name for a product type, a name usually trademarked at great
expense, becomes used and thought of that often, it assures continued strong
sales as long as the original quality remains. I would love nothing more
than to see anglers starting to refer to all spinnerbaits as " 'Weapons."
Keep using the Senko name here; Gary earned it.

Except when you allow the public to use your trademark name your running a
_big_ risk of not being able to enforce the trademark any longer. As I
mentioned in my post, Kleenex and Aspirin come to mind. This is why
companies such as Mattel and McDonalds send out cease and desisted letters
for everything under the sun. Once they stop enforcing their trademarks,
they can be lost.

It is also true that a
Kleenex is a Kleenex. Brand names do describe a category, especially when
they are as successful as Senko's

Actually, when I hear Winchester, I think 'hard drive'. Maybe I'm showing
my age, but the very first hard drive that recorded on both sides of the
disk was made by IBM and was a 60 meg unit. 30 megs on each side. IBM named
it the 30-30, which quickly became the Winchester in tech support circles.


Be that as it may, Kimberly Clark spends a fortune protecting the Kleenex
trademark, as does CocaCola with 'Coke', Polaroid with their company name,
etc., etc.

Sveral brand names have legally moved into the common domain because the
copyright owners did not do enough to enforce their rights. Aspirin and
Linoleum are prime examples. General Motors spent more money policing the
rights to their trademark Frigidaire name in the 50s than they made selling
refrigerators.
