I was actually giving rw points for leaving the copyright info intact. Most
versions I've seen have that cropped or edited off, including the photo on
the Urban Legends reference page (http://www.snopes.com/photos/surfer.asp).

Consensus seems to be it was a bottlenose dolphin, though the logic on the
UL page is a bit short of conclusive.

About every other trip out, I'm treated to a pair of porpoises swimming by
at close range. Last time, they passed by within ten feet of me as I stood
about mid-thigh deep. Beautiful to see and I have to wonder at their
repeated appearances. However, once they appear, the chance of hooking
anything is blown for quite a while.

Giving points is nice, but Wolfie's insinuation is correct. Including the
copyright isn't enough, even if the picture is posted on other sites (its
probably posted there illegally.) You need explicit permission from the
copyright holder to use the image, or even to link to it on another (even
illegal) site. Here is a readable site about copyright law:

Since the photographer is selling copies of the image, my guess is that he
wouldn't give permission for it to be used on rw's webpage. I'm not gonna
tell or anything g, but your response showed a common misconception about

Actually, I knew that it is incorrect to use the image w/out permission (I
buy a lot of images in my job); I only meant that Steve had at least
acknolwedged who he stole it from. g

I found it interesting that the UL site (which seems to have copied and
cropped the original) actually included a link to the photographer's site
that says on its front page:

"All photos are property of and Registered Copyright of Kurt Jones.
Use of any image including downloading, copying, or manipulating is
PROHIBITED !! Violators will be prosecuted to the fullest extent of
the law."

Maybe they obtained permission but I doubt it...anyways the photographer
himself has the full explanation at:
