Interestingly the use of the magic MUST NOT wording is missing so presumably Para 242 is advisory and not reflecting a legal requirement. As I understand it the offence of nearside overtaking was removed many years ago and currently the offences of careless or worse driving are used. Must go and rummage in the law books to check.
