Get legal advice -- I dealt with Alamo once I was left with a very
sour impression. I wouldn't be suirprised if they've sent this claim
to a half-dozen renters to see if they can get one to pay. Also
contact a consumer protection agency.

Good advice, well taken. I was kind of thinking that maybe they were
pinning on whoever they could find who would just pay it. A Consumer
Protection Agency is a great idea I haven't thought of, are there many?
I'll cruise Google and see what I find..

hmmm....didn't indian joe drive that car? g as i recall, the vehicle
was in fine shape when we all departed for home. what is the claimed
damage?

Indian Joe wasn't behind the wheel, at least as far as I am aware (there may
have been a time or two where I wasn't aware thanks to the generosity of
fellow Roffians).

It needed a wash when it left town, but no damages. I pulled over in one of
those Photo Op turn outs along the highway across from the airport (the
airport is in a valley beneath the majestic Grand Tetons), did a visual
check of the car and cleaned out all of the trash. I always do this before
I turn in a rental car. If there was a chance I missed anything before
that, I would have caught it there.

They claimed "Dented and Scraped from passenger side front door to pass
side rear fender",

bull****....to say the least.

contact the wyoming attorney general's office of consumer fraud (or
whatever passes for it out there... warren? john?) and file a complaint.
tell your insurance company it's a bogus complaint and that you won't
consent to payment without a full investigation and explanation.

Sounds like some more good sound advice. I'll Did go through the insurance
agent and they seemed to indicate that the insurance company would just pay
it, but if my premium goes up they get their money back in the long run
anyway so probably don't care. Didn't put my foot down through, so I'll
run it by them again.

they can settle without your consent, but you need to be on record with
them in order to fight premium increases...if they pay, they consider it
as your fault and your premium will increase if the payment exceeds a
designated amount...usually $750. get all the facts you can. i'm sure
several of us can sign an affidavit as to the condition of the body of the
car on the day you left...wasn't it an suv chevrolet or jeep kinda thing?
g

Chevy Trailblazer (I knew there wasn't something I didn't like about it).
I'll keep the affidavit stuff in mind, and I thank you kindly for the
support.

usually, at that level of claim, most folks and companies try to avoid
legal fees or extra costs. they count on you making the expedient
economic decision. but, some states grant attorney fees to consumers who
prevail in such cases. don't give in. it's likely they'll concede if you
persist and hang in there.

How can I find out if a state could grant attorney's fees? One of the other
reasons I hesitate to have it go to court is that in the agreement it
states: "I agree to pay your reasonable attorneys fees and costs in any
lawsuit relating to this agreement, including appeals." . Can they really
do that? Make me pay for their attorney fees?

Alamo is off our rent list for a couple of reasons. None as bad as yours.
Once we had a car with a bad bearing -squeeled something like a 747, I
can't
believe they couldn't hear it. The other two times were cars that were
not
available. We had gotten confirmed car pickups and then the cars wern't
there. Once we had to wait 3 hours and the other time go to the Avis
counter. The guy who's running the class action suit against them is on
the right track.

I'm getting the impression that Alamo isn't the best rental company. I did
rent from Alamo in Orlando after the Clave, and before they notified me, and
that car had some light damage on it when I rented it. I noted it with the
security guard on the way out, and thinking now that was a good idea. Too
bad I didn't get someone to attest to the condition of the car when I turned
the truck back in, in Jackson Hole. Needless to say Alamo has been added to
my blacklist.

Thanks for your comments.

You could subpoena ALL of their rental records in court...

john

May have to do that if it comes to that. I'm hoping to find a more
expedient resolution, but will do what I have to.

Thanks for reading, and for your input,

Almost four months after the Western Clave I recvd a call letting me know
that I owed $1900 for damages to the rental car (actually truck) I had

while
I was attending the Western Clave this past year. There was no damage to
the truck, I am sure of that, but having a tough problem disputing the
claim. Seems as though Alamo wants to "pursue the claim" despite my

dispute,
and if I don't pay they will report it to the credit agencies.

-----------------
Mike, about a billion years ago, I had a similar experience on Molokai
Hawaii. If memory serves, I wound up not paying because they had an
obligation to report the damage to me in a timely manner (I think it was
that they had to note the damage upon return, but I could be wrong here).
Also, when I turned in the car, the attendant made no note of any damage
(there was none done by me, anyway). American Express helped me in
disputing the claim. Ironically, the car rental agency in question for me
was Alamo as well.

Hmm, maybe I should check my credit card company and see what coverage I
have on the one I used for the rental. Maybe they would be more helpful???

If the truck had $1,900 worth of damage it shouldn't have been rented
again
until it was fixed. You should be able to get a copy of the repair order
and rental history for this vehicle. If they rented it after you and
before
the repair...things should go your way for sure, I would think. They be
some attorneys here and they, of course, now all the legal ramifications
for
you.

Hang in there and don't let the *******s get you down!

Chris

Go the repair Order, it was for $1395.25. The rest is the administrative and
loss of rental charges.

Thanks for your input, and your time.

Will check this one out. The situation is a bit different, but similar in
that Alamo seems to be asswipes here too. Maybe this guy has input from his
experience, or from others, that would help.

Thanks

Mike I found this:
http://www.my3cents.com/showReview.cgi?id=5913&wrapper=

"I CAN BE CONTACTED AT . I WILL ALSO BE LOOKING
INTO THE POSSIBILITY OF A CLASS-ACTION LAW SUIT AGAINST ALAMO TO PUT A
HALT TO THESE DECEPTIVE BUSINESS PRACTICES."

You may want to contact this fella, as his problems occurred in June and
might have been resolved by now.

Wow, that is a sleazeball move. Alamo is really starting to smell..

Thanks,

Mike, you can probably get some free advice to start with at a local

law school. Many years ago I contacted George Washington law school
and they put me in touch with someone who is knowledgeable on the
topic. I don't know where you live but you can probably search the web
for schools that have such programs and they don't have to be local to
you.

Hope this helps.

Knowledgeable on this topic, or just in general?
