Yellowchaser - there is a charge for using copyrighted text and pictures
from my site like you did with the article and pictures on the world record bass. I am sending the information to About and they will send you a contract to use this material - I don't remember getting one from you. Please remove my copyrighted material until you sign the contract and pay the fee. Ronnie Garrison http://fishing.about.com |

Ronnie Garrison http://fishing.about.com For those who are interested in copying information from other sites, etc...there is a great site that talks about copyrights and the many exceptions is at: http://www.copyright.iupui.edu/quickguide.htm The most common exceptions are what they call "fair use" and "education" purposes. IMO, a good test is whether the materials are being republished for the purpose of making a profit. If it isn't and you're not posting a whole bunch of information...chances are you are ok. However, if you're making a profit off of em' or using a bunch of someone else's information...chances are you're stepping over the line and infriging on someone else's work. This is not legal advice. Talk to an attorney in your state if you have an issue with this. This is just a "my opinion" reference for folks here that might want to post a picture or article from another site...or "hundreds" of articles...: -- Dwayne E. What he had done was copy an article from my site, with five pictures in it, and posted it on his as an article from him. I was pretty mad when I found it and did not see the email to him on that page or to a webmaster so I posted here and other newsgroups knowing he visited here. It was the only way I knew to contact him at the time. I am pretty sure copying an article and pictures and posting the whole thing as yours is a copyright violation. He did not even link back to my site or give me credit. He did leave "picture by Ronnie Garrison" under the photos. Since he sells advertising on his site I guess that means he is making a profit from my article he posted? |

I suggest that if the content is not removed, you drop a note at http://www.ezzi.net/home/company/index.cfm?do=Contact Ezzi.net's acceptable use policy includes: # Transmitting on or through any EZZI.NET service any material that is unlawful, obscene, harassing, threatening, abusive, libelous or hateful, or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law, including but not limited to direct or indirect threats of physical harm or the transmission or display of child pornography. # Transmitting, distributing, or storing any information, data or material in violation of U.S. regulation or law; state regulation or law; common law; or the laws and regulations of any jurisdiction in which EZZI.NET does business and/or the violation emanates, is received and/or occurs, including but not limited to material protected by copyright, trademark, trade secret or any other proprietary-rights statute. Examples of such might include posting, uploading or otherwise distributing copyrighted material without the consent of the copyright holder, except when pursuant to the Fair Use Doctrine. # Violating the personal-privacy rights of others, including but not limited to collecting and distributing information about Internet users without their permission, except as permitted by applicable law. # Intentionally omitting, deleting, forging or misrepresenting transmission information, including but not limited to headers, return-address information and IP addresses, or taking any other action intended to cloak the identity or contact information of the Client or its users. They also have a usenet policy: Usenet. Users who post messages to Usenet newsgroups are responsible for becoming familiar and complying with any written charter or FAQ governing the use of such newsgroups. Regardless of such policies, users may not: 1. post the same message, or a series of similar messages, to one or more newsgroups (excessive cross-posting or multiple-posting, also known as "Usenet SPAM"); 2. post binary files to newsgroups not specifically named for that purpose; 3. solicit mail for any address other than your EZZI.NET account(s) or service where doing so would manifest an intent to harass others; 4. post messages for the purpose of threatening, harassing or intimidating others; 5. post messages that infringe on the personal or property rights of others (privacy rights or copyrights, for example); 6. cancel messages other than those you originated, with the exception of official newsgroup moderators performing their duties; 7. post any message with forged packet header-information; and/or 8. post messages that are excessive and/or intended to annoy or harass others, including, without limitation, messages promoting chain letters, pyramid schemes or make-money-fast schemes. Also, "EZZI.NET Clients are solely responsible for any misuse of their account, even if the offending act or conduct was committed by, results from or arises from the act, omission or behavior of someone other than the Client. Thus, Clients must take the necessary precautions to protect access to and use of their accounts." This means Yellowchaser's disclaimer that he's not responsible for content posted through his site is not valid so far as his web host is concerned. Scott |

... He removed the article and pictures he had copied from my site. Looks like he's removed the whole site. Nothing but a test page. Looks like he had given up on obtaining any pay advertisers. Most people of his caliber fade away quickly. |
